Will of Richard HIND (-1712)

In the name of God Amend. I Richard HIND of the parish of Saint Andrew Holborn in the County of Middlesex [Brewer?] do make and declare this my Last Will and Testament in manner following That is to say. Whereas upon or before my marriage with my dear wife by Articles of Agreement bearing date on or about the fifteen day of February AD One thousand Six Hundred Ninety Six [1696] made or mentioned to be made between the said Richard HIND of the one part and Peter COLSTHORPE of the parish of Saint Andrew Holborn in the County of Middlesex aforesaid apothecary and my dear wife by the name of Mary GELSTHORPE spinster daughter of the said Peter GELSTHORPE of the other part. I did covenant and agree to lay out the sum of four thousand pounds in the purchase of an estate of inheritance in the Kingdom of England and to settle the same to the use of myself for life and after my decease to the use of my wife for life for jointure and after our decease to the use of such Children as I should appoint and for the want of such appointment to the use of all my Children on the body of my said wife be begotten and the heirs of their bodies issuing as tenants in common and for want of such issue to my executors hereinafter named (in performance of my Covenant and Agreement in the said articles contained) with all convenient speed after my decease to lay out the said four thousands in such purchase as the said Articles direct and to convey and to settle the same to the use of my said dear wife for her life and after her decease to the use of all my children now living on her body lawfully begotten and the heirs of their bodies issuing as tenants in Common and not as Joint tenants with remainder to my own right heirs in such sort and manner as Counsel shall advise and as may answer the design of the said articles.

I will and give the sum of one thousand pounds more to be laid by my executors together with the said four thousand pounds in such purchase as aforesaid and that the same to be settled to the same use as the estate to be purchased with the said four thousand pounds is to be be settled upon and in the mean time until such purchase can be had I will and appoint that the said four thousand pounds and one thousand pounds be put out at interest and that the interest as and be applied  in such manner as the rents and profits of the lands to be purchased would go in case a purchase were made.

Item I give and bequeath unto my dear wife all plate, jewels, household goods, household stuff and furniture and one hundred pounds in money.

I give unto my sisters Anne and Sarah HINDE and to my brother Benjamin HIND one hundred pounds apiece.

I give to my two clerks Mr WAINWRIGHT and Clark Cousin John HAWKINS five pounds apiece for mourning and to my friend John JACOB ten pounds for mourning.

All the rest and residue of my estate real and personal whatsoever and whosesoever I give and bequeath unto all my children equally among them share and share alike and to the survivors and survivor of them his her or their heirs executors or Administrators.

And I make and ordain my dear and loving wife Mary HINDE and brothers Mr Robert HINDE and Mr John GOULD three executors of this my Last Will.

In witness whereof I the said testator Richard HINDE have to this my Last Will and Testament written on two sheets and one half sheet of paper and joined together and sealed at the top to each sheet set my hand and seal the third day of March AD one thousand seven hundred and three [1703] and in the second year of the reign of our sovereign Queen Anne over England. Richard HINDE / Signed and sealed published and declared and delivered by the said testator for and as his Last Will and Testament in the presence of us whose names are subscribed after he had willed and appointed fifty pounds apiece to his executors for their trouble and six pounds for the poor of Saffron Hill liberty in the parish of Saint Andrews Holborn and four pounds to the poor of Mr TAYLOR’s congregation John JACOB Benja KOM Richard YOUNG.
